2. DISPUTE RESOLUTION

In accordance with the provisions of Articles L 611-1 et seq. of the French Consumer Code, any consumer dispute may be subject to an amicable settlement through mediation with the CMAP – Centre de Médiation et d’Arbitrage de Paris. The mediator may not review disputes where the request is clearly unfounded or abusive, has already been or is currently being examined by another mediator or by a court, where the consumer has submitted their request to the mediator more than one year after their written complaint to our company SGRHVS MONTEMPÔ, where the dispute does not fall within the mediator’s scope of competence, or where the consumer cannot show that they first attempted to resolve the dispute directly with our Company through a written complaint, in accordance with the terms provided for, where applicable, in the contract, which remained unanswered for 60 days.

To submit your dispute to the mediator, you may (i) fill out the form on the CMAP website: www.cmap.fr under the “vous êtes: un consommateur” tab, (ii) send your request by regular or registered mail to CMAP Médiation Consommation, 39 avenue Franklin D. Roosevelt, 75008 PARIS, or (iii) send an email to consommation@cmap.fr. Whichever method you use to contact the CMAP, your request must include the following information to be processed promptly:
Your postal address, email and phone contact details, as well as your full name and address, together with a brief summary of the facts and proof of the steps previously taken with our Company or the establishment concerned.

3. Personal Data

The Customer’s personal information and data are intended for SGRHVS MONTEMPÔ, the data controller, as well as its subcontractors, and are necessary for managing their stay and the business relationship arising from this Agreement. Where the Customer has been referred to the Residence through (i) the State representative in the department or their delegates, or (ii) another legal entity acting on the Customer’s behalf, information relating to the Customer’s stay may, within the limits and under the conditions set out in the booking agreements concluded between SGRHVS MONTEMPÔ and such organizations, be transferred to the organization concerned as part of the follow-up of the booking made on the Customer’s behalf. The Customer is informed of this automated processing of information, in particular the management of their email address. The Customer’s personal data file has been declared to the CNIL.

In accordance with the French law of January 6, 1978, the Customer has the right to access, rectify and delete their personal data, as well as the right to object, on legitimate grounds, to its processing. To exercise this right, simply submit a request stating your surname, first name, email address and, if possible, your Customer reference, to:

Except with the Customer’s express authorization to this effect, and notwithstanding the case mentioned in the first paragraph of this article, the Operator undertakes not to disclose, on its own behalf or on behalf of a third party, for marketing purposes or for free or paid distribution, the personal data made available by the Customer. It undertakes to keep all personal data provided strictly confidential and to use it only for the purpose for which it was provided. Upon expiry of the contract, the Operator undertakes to destroy, within the legal time limits, any medium containing this personal data and to keep no copy allowing such data to be communicated.

4. Opting Out of Telephone Solicitation

In accordance with Article L.223-2 of the French Consumer Code, consumers who do not wish to be subject to telephone solicitation may register free of charge on a do-not-call list. This list can be accessed via the following website: www.bloctel.gouv.fr.

5. Technical Information
